Terms of Service

1. Acceptance of Terms

By creating an account and using 9Checks, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are using 9Checks on behalf of a business or organisation, you confirm that you have authority to bind that entity to these terms.

2. Description of Service

9Checks is a property management platform designed for landlords and property managers. It provides tools for managing tenants, tracking rent, conducting inspections, sending digital contracts, and handling maintenance requests. The platform is provided on a subscription basis.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorised access to your account. 9Checks is not liable for any loss resulting from unauthorised use of your account. You may not share your account with others or create multiple accounts for the same individual.

4. Subscription and Billing

9Checks offers subscription plans on a monthly or annual basis. By selecting a paid plan, you agree to pay the applicable fees.

• Free trials are available for new users as stated on our pricing page
• Subscriptions automatically renew unless cancelled before the renewal date
• Prices are listed in South African Rand (ZAR) and are subject to change with notice
• Refunds are handled on a case-by-case basis, contact us within 7 days of a charge if you have a billing concern

5. Acceptable Use

You agree not to use 9Checks for any unlawful purpose or in any way that could harm the platform or other users. You must not:

• Upload content that is illegal, fraudulent, or infringes on third-party rights
• Attempt to gain unauthorised access to other users' data
• Use the platform to harass, threaten, or discriminate against tenants
• Reverse engineer, copy, or reproduce any part of the platform without permission
• Misuse tenant data in violation of applicable privacy laws

6. Your Data and Content

You retain ownership of all data and content you upload to 9Checks. By uploading content, you grant us a limited licence to store and process it solely for the purpose of providing the service. You are responsible for ensuring you have the right to upload and store any data relating to third parties, including your tenants.

7. Digital Signatures

9Checks provides digital contract signing functionality. By using this feature, you acknowledge that electronic signatures created through the platform are intended to represent a binding agreement between the parties. You are responsible for ensuring that your use of digital signatures complies with the laws applicable in your jurisdiction. 9Checks does not provide legal advice.

8. Limitation of Liability

9Checks is provided on an "as is" basis. To the fullest extent permitted by law, we exclude all warranties, express or implied. We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform, including but not limited to loss of data, lost revenue, or business interruption. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.

9. Service Availability

We aim to maintain high availability of the platform but do not guarantee uninterrupted service. We may perform maintenance or updates that temporarily affect access. We will endeavour to provide advance notice of planned downtime where possible.

10. Termination

You may cancel your account at any time from your account settings. We reserve the right to suspend or terminate your account if you violate these terms, without refund. Upon termination, your data will be retained for 30 days before permanent deletion, during which time you may request an export.

11. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes via email or an in-app notice. Continued use of the platform after the effective date of any changes constitutes your acceptance of the updated terms.

12. Governing Law

These Terms of Service are governed by the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
